Maharashtra Drafts India's First Blockchain Property Law

Synopsis: Maharashtra has initiated the drafting of India’s first blockchain-based property law to enable land tokenisation, digitise real estate transactions, and create a secure legal framework for blockchain-enabled property ownership.

The Maharashtra Government has embarked on the process of drafting legislation that will mark the emergence of the first block chain-enabled property law in India. This will create a legal basis for the digitalization and tokenization of immovable property in the country. The purpose of this law is to transform the real estate sector of Maharashtra.

The Chief Minister of Maharashtra, Devendra Fadnavis, has instructed the government to draft an act called the Maharashtra Digitisation and Exchange of Land Token Assets (DELTA) Act that will give a statutory identity to blockchain property tokenisation. This law aims to create a digital environment where land and property can become digital identities using blockchain technology.

In this regard, the suggested model will see that all the immovable properties are tokenized based on their intrinsic values through blockchain technology. This will make property transactions faster, safer, and more transparent with an unalterable history of ownership rights. According to the government, this will help to unlock the 'latent value' of real estate assets.

In order to facilitate this process, the government has suggested forming a committee at a high level, which consists of representatives from SEBI (Securities and Exchange Board of India), BSE (Bombay Stock Exchange), NSE (National Stock Exchange), and experts from the blockchain sector, financial sector, legal sector, and the real estate sector. This committee will study foreign regulations and best practices for asset tokenisation before passing the legislation.

As explained by the government, the DELTA Act will guarantee legal clarity regarding blockchain property transactions but without interfering with ownership. This framework will create clear guidelines on the recording of property in a digital format, issuance of tokens, ownership verification, transfer, and dispute resolution in order to increase investor confidence.

The project is also a component of the larger digital governance plan for Maharashtra and reflects the state’s vision of creating a US$1 trillion economy by 2030. The government sees the use of blockchain technology in making the process of buying and selling of properties simpler, safer from fraudulent activities, more transparent, and liquid.

Blockchain provides a decentralized system for creating immutable digital records. This makes it especially useful in cases of land registration and proving ownership of land. The system ensures that there is less chance of errors due to faulty documentation, and there is less chance of title verification challenges due to fraudulent and duplicate records. This has made many governments consider use of blockchain in land administration.

Earlier, Maharashtra has tried its hand at blockchain in property registration processes through pilots that involved digital registration records and banks. The DELTA Act would be a major step in comparison to that since it will form a legal structure for the regulation of blockchain technology for property tokenization.

It is believed that should this law be passed, then it would put Maharashtra in a leadership role in terms of digital management of its real estate assets in India. Through the use of legal recognition and blockchain technology, the proposed system has the capability to revolutionize property ownership and transactions, thus making it more attractive to investors.
